help with a speeding ticket?

i need help! ne one know how i might be able to get this ticket thrown out? i was doing 52 in a 40 but my speedometer read between 40 and 45 from the time i saw and passed the cop. i was hoping there'd be some way i can prove my speedo is off cuz i wasn't aware that i was speeding. i went to one automotive shop and he asked if i had changed my rim and tire size and i said yes, the stock ones are 13's and they have 15's on right now. and he said he can almost garantee that's what's throwing it off but he didn't give me a written statement or ne thing. and he told me the judge isn't gonna look at that, he's gonna look at whether or not i was speeding. i already have 4 tickets on my record, or is it 5? damnit i don't know but i can't afford another one FUCK!

How did the cop clock you? Was he timing, radar, etc.?

I know in some states you aren't allowed to alter the overall diameter of the factory wheel. If your wheels are screwing up the speedometer then they aren't the same diameter as oem. It's one of those laws that aren't enforced much unless the cop feels like being a dick.

Make sure everything is kosher. Make sure the cop used an accurate form of measurement when he clocked you. Make sure that nothing was looked over or missed. Etc. There's a chance that if you do challenge it and plead not guilty that they'll reduce the ticket to just the fine with no points or like Tom said...disobeying traffic laws.

My sister got out of a 85mph in a 55. She just pleaded not guilty and the judge lessened it to a $90 fine.

I don't think anyone in the legal system will cut you any slack for a malcalibrated speedo. Cops want YOU to be responsible for your car operating right. If you used that excuse, they might come back with something like, "It was you who altered the vehicle and you are responsible for the consequences of your modification.".

I've always heard to plead "No Contest", but it might vary from state to state.

pleading no contest means you're fully accepting the ticket... why would you do that?

as for the oversized rims, you might as well just go in and be honest, and tell them you had no idea it made a difference on the speedometer. It's not like you were going a hundred over. It's basically going to come down to what kind of judge you get. I would say your best bet would be to say something like you swapped on a set of winter tires you got for free from someone, and didn't even realize that they were larger or that it would make a difference. Course, depending on where you are in washington you may not even get snow so that might be harder to sell. But you could just as easily say you swapped on the rims from your old car or something and say you didn't realize there would be any difference.

Moral of the story: you better be good at bs'n your way out of trouble, and you better come up with a good story right now and make sure you have it down so there's no holes in it. And then pray you get a nice judge.

he was using radar and he had it pointed right at the front of my car from a distance, there were no other cars around. and im taking notes right now so i can just use those when i go into court and basicly im just gonna tell the judge i wasn't aware that i was speeding because i had no idea that my speedometer was even off and had i have known that i would have corrected the problem. and at the time i didn't realize putting a differen't size tire and rim was going to effect my speedometer reading.

if it was clocked u chould fight it... radar its almost impossible to win... radar is corret. being timed is another story. u wasnt going that fast over the speed limit...

u could always goto court and say your a student trying to pay bills working a steady part time job. christmas really has you run down because of the bills. yada yada. pretty much explain to them u dont have the cash. sometimes they let you slide, sometimes not, sometimes they less the fine, sometimes take off points.
